How Divorce Works in Kentucky
Kentucky uses a no-fault standard for divorce, formally called dissolution of marriage. Either spouse can seek dissolution by showing the marriage has suffered an irretrievable breakdown, with no proof of wrongdoing required. Before filing at Kenton County Family Court, at least one spouse must have been a Kentucky resident for a minimum of 180 days.
Kentucky also requires couples to be separated without sexual cohabitation for at least 60 days before a divorce is finalized. That separation can occur while both spouses remain in the same home. A mandatory 60-day waiting period applies before the court can enter a final decree, and for couples with minor children, an additional procedural requirement under KRS 403.044 governs the timing of testimony and hearings. The petition filed with the court states these statutory facts and asks the court to resolve issues such as custody, support, property division, and maintenance.
